According to a report by ABC13, Authorities accuse Lucio Diaz, 53, of infecting at least 13 people. He faces charges of indecent assault and aggravated assault with a deadly weapon. The 'deadly weapon,' in this case, is Diaz's bodily fluids containing the Herpes Simplex1 Virus.
Per a report by People, Diaz pleaded guilty to the charge and faces a six-year jail term. Authorities sentenced him this week, although an employee reportedly discovered his actions back in September 2022. That employee told police that she noticed the water from the dispenser had a "funny taste and smell" to it. She allegedly started to bring her own bottles to work but noticed the same foul odor when she left them unfinished on her desk. At the time, she just threw the bottle away rather than trying to figure out what happened.
However, three weeks later, a co-worker offered to make her a coffee. She warned against using the communal water dispenser and handed over her water bottle instead. The co-worker asked why the water was discolored, and the pair quickly realized it was urine. The workers requested a urinalysis test for the liquid at work, which was positive.
The employee even brought a hidden camera to confirm her suspicions. The complaint reportedly said she "observed the janitor, a person she knows as Lucio, open her water bottle, which was placed on her desk, unzip his pants, remove his penis from his pants, and place the head of his penis into her water bottle, causing the entire mouth of the water bottle to touch his penis."
The Janitor's Victims Have Filed A Lawsuit Against The Management Company
Per ABC13, thirteen workers are suing the building's management company, the building owner, and maintenance and cleaning companies. Despite the video evidence, their attorneys allege that the companies allowed Diaz to keep working as a janitor. Building management reportedly failed to notify workers of the situation for 6 days after viewing the footage. The law firm representing the victims reportedly seeks over $1 Million for each claimant, as this is something that 'is not going to go away.'
