Teen Accused of Fatal Hit-And-Run Of Bicyclist, Allegedly Filmed And Posted the Incident Online

A 13-year-old in New Mexico, Johnathan Overbay, has been arrested and charged with murder in connection with the death of 63-year-old physicist, Scott Dwight Habermehl, back in May 2024. Police believe that Overbay drove his vehicle and intentionally hit Habermehl while he was riding his bicycle. An 11-year-old boy was also taken into custody while police continue to search for 15-year-old William Garcia.

According to a press release issued by the Albuquerque Police Department (APD), the incident took place on May 29, 2024, at around 4:40 a.m. The victim, Habermehl, was driving his bicycle to work while the three teenagers were inside a vehicle, recording from inside the car.

Overbay then allegedly drove the car onto the dedicated bike land and struck Habermehl. The crash carried Habermehl alongside his vehicle on top and off the car's passenger side, which resulted in Habermehl's death. Unfortunately, at the time, police were unable to determine who was behind the intentional crash.

Video Recorded And Posted

On February 2025, however, the APD received an anonymous tip saying that a video of the crash was posted online. The identity of the Instagram account where the clip was posted and the user was also part of the tip. A middle school principal also reported to Albuquerque Police Schools that a student reported the same video of the crash.

Police managed to secure warrants for social media accounts and got hold of Overbay's and the 11-year-old's phones. These phones were previously seized during a separate investigation back in June 2024. Police found several videos showing the three boys and also found the original video of the crash.

In the video, police report that a conversation between the boys revealed Overbay's intention to hit Habermehl. "The back passenger, believed to be [the 15-year-old], said not to hit the bicyclist going too fast. 'Just bump him, brah,'" the police reported. "The driver responded, 'Like bump him?' [The 15-year-old] repeated, 'Yeah, just bump him. Go like...15...20.'"

The video also captured who appears to be the 11-year-old ducking, laughing, and waving a handgun as Habermehl gets hit by the car.

Arrested And Charged

Johnathan Overbay was charged with an open count of murder, conspiracy to commit murder, leaving the scene of an accident involving great bodily harm or death, and unlawful possession of a handgun by a person. The 15-year-old boy, William Garcia, was charged with the same crimes. He remains on the run. The 11-year-old is too young to be charged with murder. It is up to the District Attorney's Office and the Children, Youth, and Families Department to determine his charges.

New Mexico Governor Michelle Lujan Grisham issued a statement, following the teenagers being arrested and charged.

"I am horrified by the video footage of a brazen, heartless killing involving three New Mexico juveniles—ages 11, 13, and 15—who targeted an innocent cyclist," Grisham wrote. "This case is an appalling and heartbreaking reminder of the serious juvenile crime crisis we face in New Mexico--and our lack of tools to properly address it."

    I know he was a cop but in a story a while ago I commented that I wouldn't stop to help someone, I would call 911 and report something but I wouldn't stop because you never know, I was called selfish and all kinds of names. Germans are required wuto take a first aid course as part of the driver's test, had you ever wondered why all German vehicles come with a first aid kit? In Germany you are required to stop if you see an accident and administer first aid, if you don't you can be in serious trouble if caught, if you don't believe me look it up.
