Former Oklahoma judge Jerry Herberger, 73, is accused of firing shots at trick-or-treaters and a police officer who responded to the disturbance.
Herberger fired at the costumed individuals around 8 PM on Saturday, police told KSWO.
Luckily, authorities stated that the retired judge misfired and no injuries were reported. He did not fire his weapon at the responding officer. Police have not determined the motive behind the shooting.
Oddly enough, the former judge was booked into Stephens County, where he used to work.
Herberger is being charged with possession of a firearm while intoxicated, which carries a maximum jail sentence of six months in Oklahoma.
The former judge also risks losing his gun license and being charged with a $500 fee for the misdemeanor.
For his battery with a deadly weapon charge, Herberger faces potential life imprisonment.
Herberger was not the only person to find trouble while others were trick-or-treating. A restaurant worker in Alabama lost her job after going viral for stealing nearly an entire Halloween bowl.
Worst part, she didn't even have a costume.
Woman Loses Job After Swiping Excess Halloween Candy
Doorbell footage captured two women swiping the contents of a candy bowl left out for children.
One of the women, dressed in her work uniform, took several large scoops of candy from the bowl, enough for dozens of trick-or-treaters to enjoy.
The person who originally posted the video on
Facebook wrote, "Greedy adults stole almost the entire bowl of candy," the post reads. "Literally left almost nothing for the children!! Absolutely pathetic. Sakana Sushi Bar & Grill is this one of your employees."The sushi bar released a statement after the Halloween heist went viral.
"We take this matter seriously, and we certainly do not condone behavior that takes away from children or the community," the statement reads.
"We're looking into this and will address it appropriately if anyone associated with Sakana was involved. We value our community, our customers, and especially the families and children we serve. We would never encourage or support this kind of behavior."
Ultimately, the employee was let go after the restaurant discovered she lied about apologizing to the homeowner.
