Why Is Costco Part of a Class Action Settlement?
As reported by Parade, a lawsuit alleged that Costco sent promotional emails to customers in Washington state with false or misleading subject lines.
The messages promoted limited-time sales, creating a sense of urgency for consumers. However, the promotions were allegedly extended when the emails were sent out.
The suit argued that the emails allegedly violated Washington's Commercial Electronic Mail Act and Consumer Protection Act. Despite the settlement, Costco has denied the claims.
The settlement was preliminarily approved on July 2. It creates a $14 million fund for eligible consumers.
Who Is Eligible for a Settlement Payment?
Consumers who are eligible for a settlement payment from Costco are Washington residents who received a promotional email from the company between June 2, 2021, and July 7, 2026.
No proof of purchase is required to claim a settlement payment. But the exact amount of the cash payment will depend on how many claims are filed. Forms need to be submitted by Aug. 24, 2026, to be eligible.
Additionally, the settlement still needs final approval from the court. A hearing is currently scheduled for Oct. 2, 2026. If the agreement receives final approval and appeals are resolved, cash payments will be sent to approved claimants.

Costco is currently facing another lawsuit from earlier this year over its Kirkland Signature Seasoned Rotisserie Chicken. While the label claims the item has "no preservatives," the plaintiffs in the proposed class-action suit argue that two of the chicken's ingredients, sodium phosphate and carrageenan, function as preservatives.
USA Today then reported in June that Costco plans to ask the court to dismiss the suit, saying it is changing the labeling on the chicken in mid-August.
